Overview

These Terms & Conditions apply to all purchases made from Save State Games via our website, online marketplaces, or any other sales channels. By placing an order, you agree to these terms.

Australian Consumer Law (ACL)

Nothing in these Terms & Conditions excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).

Our goods come with guarantees that cannot be excluded under the ACL, including that:

Goods will be of acceptable quality
Goods will match their description
Goods will be fit for purpose (as disclosed by us or made known by the buyer)

You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Products

We sell pre-owned and/or vintage video game cartridges and related items.

All items are:

  • Used unless otherwise stated
  • Tested and confirmed working where specified
  • Sold as physical goods only

Due to age, items may show cosmetic wear consistent with normal use unless otherwise stated.

Condition Disclosure

We aim to accurately describe all items, including:

  • Functionality
  • Cosmetic condition
  • Included accessories

Items are typically sold as:

  • Cartridge only (no box/manual unless stated)

Photos form part of the item description.

Pricing & Payment

Prices are listed in AUD
Prices include shipping unless otherwise stated
Full payment is required at checkout
Orders are dispatched only after payment is received

Shipping

Orders are shipped within Australia unless stated otherwise
Tracking is provided where available
Delivery timeframes are estimates only

We are not liable for delays caused by postal services or third-party carriers.

Returns & Remedies

If a product fails to meet an ACL guarantee, you are entitled to a remedy depending on the issue:

  • Major failure: refund or replacement (your choice)
  • Minor failure: repair, replacement, or refund at our discretion

We may require evidence of the issue (e.g. photos or video).

We do not accept returns for:

  • Change of mind
  • Buyer compatibility issues not disclosed at time of purchase
  • Minor cosmetic wear consistent with vintage items

However, nothing in this section limits your rights under the ACL.

Compatibility

Import cartridges (e.g. Super Famicom / Japanese region games) may require compatible hardware.

We are not responsible for issues arising from incompatible systems where compatibility was not part of the listing description. If you are unsure, please contact us prior to purchasing.

Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect or consequential losses
We are not liable for damage caused by misuse or improper handling

Nothing in this section limits your rights under the ACL.

Intellectual Property

All product names, trademarks, and game titles remain the property of their respective owners. Save State Games is not affiliated with Nintendo or any other publisher.

Changes to Terms

We may update these Terms at any time. The latest version will be posted on our website.
